Membership Terms and Conditions

These Membership Terms and Conditions (“Terms”) govern your purchase, renewal and use of a Bookably membership (“Membership”) on Bookably.nz (“Bookably”, “we”, “our” or “us”). By purchasing, activating or using a Membership, you agree to these Terms.

1. Definitions

• Account – the user account you hold on Bookably.nz.
• Booking – a confirmed reservation of a property listed on Bookably.
• Host – the owner or manager of a property listed on Bookably.
• Membership – a subscription granting fee-free bookings for a fixed term.
• Membership Period – the duration of your Membership: either six (6) months or twelve (12) months.
• User Content – any data, text, images or other material you submit to Bookably.

2. Eligibility

1. You must be at least 18 years old and a resident of New Zealand.
2. You must have a valid Bookably Account with up-to-date contact and payment details.
3. Memberships are non-transferable and may only be used by the named Account holder.

3. Membership Terms & Benefits

Available Terms:

• Six-month Membership
• Twelve-month Membership

Core Benefits (for the duration of your Membership Period):

• No Booking Fees: You pay only the Host’s published rate—no platform-added service fees.
• Unlimited Instant Bookings (subject to Fair Use Policy below): Book as many stays as you like through our instant-booking system.
• Exclusive Pricing: Access lower rates reserved for Members.

All purchases include applicable GST. We reserve the right to adjust future fees or benefits; any changes will apply only to Memberships purchased after notice.

4. Activation, Use & Fair Use

1. Activation
   • Your Membership activates immediately upon successful payment.
   • You must be signed in to your Account to access Membership benefits.
2. Usage
   • Benefits apply only to instantaneous bookings made via Bookably’s platform.
   • Membership benefits cover travel for you and any guests travelling with you (e.g., friends, family).
3. Fair Use Policy
   To maintain a sustainable platform, you agree that:
   • Bookings in Member’s Name: The named Account holder must be the primary guest on every booking.
   • Personal Travel Only: Memberships are solely for non-commercial, personal or family use.
   • No Resale or Commercial Use: You may not re-sell, sub-let or commercialise any booking.
   • Reasonable Frequency: Bookings should reflect genuine travel. We may suspend Memberships used abusively or excessively.

5. Renewal (Manual Only)

• No Auto-Renewal: Memberships do not renew automatically. At the end of your Membership Period, fee-free access ends—you must manually purchase a new term to continue benefits.
• Expiry: Benefits cease immediately upon expiry. Previous term dates do not carry over.

6. Cancellations & Refunds

• No Refunds: All Membership purchases are final. No partial-term or unused-term refunds.
• Reinstatement: To return after expiry, simply purchase a new Membership at any time.

7. Modifications

• We may modify benefits, fees or these Terms at any time.
• Material changes apply only to future Memberships; existing terms remain unaffected.
• We’ll notify you of significant updates via email or a notice on our website at least 14 days before they take effect.

8. Suspension & Termination

1. By You: Allow your Membership to lapse—no further action required.
2. By Us: We may suspend or terminate your Membership (with no refund) if you:
   • Violate these Terms or any Bookably policy.
   • Engage in fraud, abuse or harmful activity.
   • Breach the Fair Use Policy (e.g., commercial resale, excessive booking).

9. Limitation of Liability & Disclaimers

• Property Availability: Membership does not guarantee any property’s availability. All bookings remain subject to Host acceptance and property-specific terms.
• Indirect Losses: To the fullest extent permitted by law, Bookably is not liable for indirect, incidental, consequential or punitive damages arising from your Membership or bookings.
• Consumer Guarantees: Nothing in these Terms excludes or limits any consumer guarantees under the New Zealand Consumer Guarantees Act 1993 that cannot legally be excluded.

10. Indemnification

You agree to indemnify and hold harmless Bookably and its officers, directors and employees from any claim, loss, liability or expense (including legal fees) arising from your breach of these Terms, misuse of Membership benefits, or violation of any law.

11. Privacy

Your use of personal data is governed by our Privacy Policy at https://bookably.nz/privacy. By using the service, you consent to collection, use and disclosure of your information as described therein.

12. Intellectual Property

All trademarks, service marks, logos, designs and content on Bookably.nz are the property of Bookably or its licensors. You may use them only as expressly authorised.

13. Notices

We may send notices by email to the address on file in your Account. Such notices satisfy any legal requirement to provide notice.

14. Governing Law & Dispute Resolution

• These Terms are governed by the laws of New Zealand.
• You submit to the exclusive jurisdiction of the New Zealand courts for any dispute.

15. General

• Entire Agreement: These Terms, along with our Booking Terms and Privacy Policy, form the complete agreement on Memberships.
• Severability: If any provision is unenforceable, the remainder stays in effect.
• Waiver: No waiver of any breach constitutes a waiver of subsequent breaches.
